Tim Flanagan – Founder and Managing Partner

Tim Flanagan supervises the corporate counsel and litigation matters for the firm. Tim began his career as a plaintiff-side litigation attorney and has taken that experience to successfully prosecute claims on behalf of community associations. His litigation successes include:

  • Jury Trial Judgment enjoining owner from renting rooms in his home in violation of the CC&Rs, along with award of $103k in fines and $1.2 Million in attorney’s fees.

  • Bench Trial Judgment and recovery of $120k in attorney’s fees against owners in a community association in Indio who violated the association’s restriction against short term rentals.

  • $200k+ settlement on a claim for a community association in the Golden Hill neighborhood of San Diego.

  • $200k settlement against a roofing contractor for a community in El Cajon.

  • Permanent injunction and attorney’s fees against an owner in a community association in Orange County who rented out rooms in his homes in violation of the CC&Rs.

  • Permanent injunction against an owner in Los Angeles County who was a hoarder and refused to clean her Unit in spite of vermin and insect infestation.

  • Summary Judgment against an owner who installed an unapproved balcony in San Diego County.

In 2019, Tim successfully argued the Orchard Estate Homes v. Orchard Homeowners Alliance case in the Fourth District Court of Appeal of California. The Orchard case was certified for publication and will be used as beneficial case precedence for HOAs in California.

Tim has represented community associations in numerous alternative dispute resolution proceedings and CC&Rs Court Petitions.

Tim’s practice includes corporate counseling where he advises boards of directors on the interpretation and enforcement of governing documents, negotiating and drafting of contracts, leases, easements and other agreements, providing guidance on compliance with the Davis-Stirling Common Interest Development Act, FEHA, ADA, and other statutory regulations, and drafting amendments and restatements of governing documents. Tim’s straightforward explanation of the legal issues aides Boards in making appropriate decisions.

Professional Memberships and Activity

Tim is an active member of the San Diego County Bar Association, Community Associations Institute (“CAI”), the California Association of Community Managers (“CACM”) and Educational Community for Homeowners (“ECHO”). Tim has served on the Board of Directors of the San Diego Chapter of CAI since 2019 and is currently the President. Tim previously served as Co-Chair of the Education Committee for the San Diego Chapter of CAI from 2015-2017.

Tim has presented several community association law classes for the Coachella Valley, Greater Inland Empire, Orange County and San Diego Chapters of CAI. He is a panelist for CACM where he has been able to teach hundreds of California community managers the basic principles of HOA law and other practice tips needed to become proficient community managers. 

In 2011, he was nominated as Speaker of the Year by the Orange County Chapter of CAI. Tim has written several articles on community association law publications throughout Southern California, and in 2016 he authored an article that was nominated as Article of the Year by the Orange County Chapter of CAI. Tim was a featured speaker at the 2019 CAI National Law Seminar in New Orleans where is presented before hundreds of HOA attorneys from across the country.
